A neighbour has painted outside wall with anti climb paint. can they do this. my child is covered in it?

the wall is on the street and my child just touched it as we walked by and he is now covered ,it spreads loads. one new karate suit needed! is it lawful to paint where it can get on anyone?A neighbour has painted outside wall with anti climb paint. can they do this. my child is covered in it?

Anti-Climb Paint (also known as Anti-Vandal Paint) is the term for a class of paint which is highly thixotropic and is often used to prevent climbing of objects such as lampposts, walls or fences... To avoid the general public being affected by it, it is usually applied from a certain height, and not directly from ground level. Typically it is applied from a height of 2 to 2.5 metres above the ground.

it sounds like its not a case of can they do this its they have done if they own the wall then i cant see them having done any wrong but if it is a public wall or council property then they shouldnt be modifying it or decorating it in anyway its not their property to touch in the first place hope this helps
when the child first';touched the paint wasn't there an indication the paint was wet? seems one little touch caused quite a lot of damage, I'll just say, I'd be a tough sell on the jury, haven't taught your child to keep his being off others property, eh!
They can do this if it is on their property/house. They aren't obligated to put up a sign, tell you or owe you for a new karate suit - buy a new suit and move on.
I can't see how if your child just touched the wall then he is covered in this paint. As it wasn't his wall what was he touching it for in the first place.

no to my understanding not just anyone can paint anti vandel paint its like you cant put barbed wire up on your own property
i hope you child did not leave marks on that poor neighbour's wall.
Sorry Luv but you cant say ';just'; touched it and is now ';covered'; in it.It doesn't make sense.
As long as they paint on their own property they can.
its never the childs fault is it?,, why you letting your child go near or climb somebody elses wall?

Have you asked your neighbour if they would be so kind as to compensate you for the damaged clothing? That would be my first approach. If no joy, write by recorded delivery or advice of posting (free) asking the same and keep a copy.


Next step is to advise that you will seek legal advice and may take action to recover damages and legal costs in the Small Claims court (keep copies). If this doesn't work. Start a claim. The advice is on the net.


Also ask your local Environmental Health Officer as they may well take a dim view of this material being adjacent to a public area.
